AT&T recently came under fire after it was caught selling the real-time phone location data of its users. FCC started an investigation to determine a Section 222 violation. But since, technically speaking, no law was broken, it’s unclear if AT&T could be subjected to any penalties.

As an American internet user, you are never informed of such cases, and it’s impossible to track which company has your data and what they do with it.

Since no one is monitoring their activity, smaller US ISPs even resorted to using malicious DNS servers to reroute your internet traffic to potentially harmful sites, all in exchange for making an extra buck.

Breaking copyright laws in America isn’t a great idea

The US generally doesn’t have a problem with torrents. But when copyrighted materials come into play, things start getting tricky.

Copyright holders in the US have been getting even more vigilant after the Copyright Alert System was put in place in 2013. They’ve started going through all the legal hurdles in order to protect their copyrighted material.

This directly impacted American torrent users, since most of these checks were enforced through ISPs. By implementing a six strikes system targeting individual IPs, users who torrent copyrighted material are subject to DMCA warning notices.

However, things can quickly escalate with avid users, since penalties for repeated offenses include fines up to $150,000 and even jail time. Yikes.

From a legal standpoint, US courts make a clear distinction between people who frequently distribute copyrighted material and someone who occasionally downloads a file. But ISPs don’t necessarily take notice of this. For instance, they can choose to reduce your internet speed drastically.

Major US ISPs have also resorted to threats over handing personal data over to the authorities.

One such case happened in 2007 when Comcast began secretly blocking peer-to-peer technologies. Its customers were unable to use services like BitTorrent and Gnutella when connected to Comcast networks.

Net neutrality has left the building

Net neutrality laws expired in June 2018. Now the American ISPs can create fast lanes and slow lanes for internet users.

Broadband providers also have the power to charge preferential rates for faster and better speeds on different websites, much like public utilities are regulated.

So, unless the service you wish to access made a sweet deal with your ISP, chances are you’ll get less than ideal speeds. Sometimes even to the point of it being unusable.

And while Net neutrality laws can change over time, the threat of imposed throttling will always remain.

ISP throttling – a common, but dangerous practice

US broadband providers are no strangers to throttling and have targeted specific services in the past. YouTube seems to be the number one target among US wireless carriers, but popular streaming services, like Netflix, Amazon Prime, and NBC have also been affected with severe buffering.

Back in 2008, one of the major providers, Comcast, amended their Acceptable Usage Policy and placed a measly 250 GB monthly data cap on users. Recently Verizon was accused of the same practices and went as far as throttling the data speed of first responders during California’s largest wildfires ever.

This trending practice also caught the eye of the FCC and FTC, that tried to regulate advertising data plans as unlimited.

Your rights on the internet are also limited to your ISP’s whims.

From 2011 to 2013, Google Wallet was completely blocked by AT&T, Sprint, and Verizon. The reason? All three companies had a stake in developing Isis, a competitor to other mobile-payment systems.

Back in 2012, AT&T also disabled FaceTime’s functions on iPhones, to incentivize their customers to subscribe to a more expensive text-and-voice plan.
